Conditional Use
Forebit may, in its sole discretion, permit Users engaged in certain businesses, industries, or activities that are not explicitly listed as Restricted Businesses but may still pose heightened risks or require additional compliance measures (collectively, "Conditional Businesses") to access and use the Services. These Conditional Businesses may include sectors that, while not outright prohibited, necessitate more rigorous scrutiny due to potential regulatory, financial, or operational risks.
If you wish to use the Services for a Conditional Business, you must adhere to the following requirements:
a. Disclose the nature of your business or activities to Forebit during the account registration process or at any time upon request. Full transparency regarding the nature of your operations is essential for Forebit to evaluate the associated risks accurately. This includes providing detailed descriptions of your business model, target markets, and types of transactions you intend to process using the Services.
b. Provide any additional information, documentation, or assurances that Forebit may require to assess the risks associated with your business or activities. This may include, but is not limited to, financial statements, business licenses, regulatory approvals, compliance programs, and information about key personnel. The goal is to ensure that your business practices align with legal and regulatory standards and that you have robust measures in place to manage potential risks.
c. Comply with any additional terms, conditions, or restrictions that Forebit may impose in its sole discretion. These additional requirements may include increased fees to compensate for the higher risk, transaction limits to control exposure, or enhanced monitoring to ensure ongoing compliance. You must adhere to these conditions to maintain your access to the Services.
Forebit reserves the right to deny or terminate access to the Services for any User engaged in a Conditional Business if, in its sole discretion, Forebit determines that the risks or compliance burdens associated with such business or activities are unacceptable or cannot be adequately managed. This decision will be based on a thorough assessment of the potential risks and the effectiveness of your mitigation measures.
